Electorate and personal employees, including senior staff, are employed by their Senator or Member under the Members of Parliament (Staff) Act 1984 (MOP(S) Act) on behalf of the Commonwealth within arrangements approved by the Prime Minister. Under authorisation of the Prime Minister, significant management responsibility for the employment framework is exercised by the Special Minister of State (SMOS).
The current terms and conditions of employment of MOP(S) Act employees are contained in the Commonwealth Members of Parliament Staff Enterprise Agreement 2012-2015, which nominally expired on 19 June 2015. This enterprise agreement continues in operation until it is replaced by a new enterprise agreement.
Negotiations for the next enterprise agreement for MOP(S) Act employees will occur between:
- employee bargaining representatives
- relevant employee organisations, being the Community and Public Sector Union and the Australian Services Union
- Ministerial and Parliamentary Services (M&PS), representing the SMOS on behalf of the Government.
The SMOS has approved replacement employment and travel arrangements for employee bargaining representatives.
