Electorate and personal staff, including senior staff, are employed by their Senator or Member under the Members of Parliament (Staff) Act 1984. The Act enables Senators and Members to employ staff on behalf of the Commonwealth within arrangements approved by the Prime Minister. Under authorisation of the Prime Minister, significant management responsibilities are exercised by the Special Minister of State.
The terms and conditions of employment of electorate and personal staff are established in accordance with the agreement making provisions of the Fair Work Act 2009. All electorate staff and personal staff, including senior staff, have terms and conditions of employment provided by the Commonwealth Members of Parliament Staff Enterprise Agreement 2016-2019 (Enterprise Agreement).
The Enterprise Agreement commenced operation on 19 April 2017.
Due to the COVID-19 pandemic, the Government has temporarily deferred bargaining for a new Enterprise Agreement.

Once resumed, bargaining will be conducted in accordance with the Fair Work Act 2009 and the Government’s Workplace Bargaining Policy 2018.
Enterprise Agreement Guidelines
The Enterprise Agreement Guidelines support the operation of the Enterprise Agreement and are made or varied from time to time following consultation with the Employee Consultative Group.
