What duties does a MOP(S) Act employee have under the WHS Act?

Every MOP(S) Act employee has the duties of a Worker under the WHS Act.

In limited cases, where a MOP(S) Act employee is authorised by a Senator or Member to make decisions that affect the whole, or a substantial part of the Senator or Member’s representative work, the MOP(S) Act employee may also have the duties of an Officer.

Does a WHS Site Officer have Officer Duties under the WHS Act?


A WHS Officer in a Senator or Member’s office, such as a WHS Site Officer, First Aid Officer or Emergency Officer, is unlikely to be an Officer for the purposes of the WHS Act, unless they participate in making decisions within their office in another capacity (for example, as a Chief of Staff).
